These Terms and Conditions govern the purchase of tickets, tours, experiences and tourist services through the website tripstorome.com.
By placing a booking, the user accepts these Terms and Conditions and the Privacy Policy of Trip to Italy srl.

## I. General
These Terms and Conditions of Sale (hereinafter "Terms" or "T&C") apply exclusively to consumers — natural persons whose use of Trip to Italy srl's services is not attributable to their commercial or professional activities.
### Operator and role
Trip to Italy srl (hereinafter "Trips to Rome", "we") operates as a **local tour operator** with registered office in Rome and three physical offices in the city (Termini, Santa Maria Maggiore, Fiumicino Terminal 1). We are licensed as an authorized tourist operator by the Municipality of Rome, license n. OA/2025/7864.
Trips to Rome operates in two modes:
**A) As direct seller** of services provided directly by Trip to Italy srl (e.g. assistance at physical offices, voucher management, WhatsApp support).
**B) As intermediary** for services provided by third parties, hereinafter "Service Providers" (e.g. museum admissions like the Colosseum, ATAC public transport, transfer carriers, independent tour operators). In such cases:
- The service is delivered by the Service Provider in their own name
- Trip to Italy srl acts as intermediary for the conclusion of the contract with the Provider
- The Trips to Rome voucher grants the customer the right to access the Provider's service under the conditions stated at the time of booking, without further payment for the service itself
### Contractual validity
The conclusion of a contract with Trips to Rome is governed exclusively by the version of these Terms valid at the time of booking. The customer accepts the Terms during the ordering process so that they become an integral part of the contract.
The Terms can be viewed, printed and saved at any time by visiting tripstorome.com/en/terms-and-conditions. The Terms are also sent by email along with the order confirmation and voucher after the contract is concluded.

## II. Booking process and conclusion of contract
### Booking procedure
1. The customer selects one or more products and clicks "Add to cart"
2. Enters personal and billing data
3. Selects the payment method
4. Clicks the "Confirm order" button or equivalent
By clicking the confirmation button, the customer makes a **contract offer**.
### Conclusion of contract
By assigning an order number and sending the booking confirmation via email, Trips to Rome **accepts the customer's offer**. From that moment the contract is concluded.
### Definition of contract subject
The booking confirmation email is the decisive document for defining the subject of the service purchased. We do not warrant that all descriptive information on the booking portal is always fully up to date (e.g. museum hours, tour routes) — what is indicated in the confirmation prevails.
### Right of cancellation by Trips to Rome
Trip to Italy srl reserves the right to cancel an order even after sending the confirmation:
- In case of customer breach of these Terms
- In case of suspected fraud or unauthorized use of payment data
- In case of manifest error (e.g. obviously incorrect price due to typo, manifestly below market value)
Cancellation can also occur by implication, by refunding the amounts paid. Upon cancellation, Trips to Rome vouchers will be electronically invalidated in the system, preventing access to Provider services.

## III. The Trips to Rome voucher
### Delivery methods
Depending on the product purchased, the voucher is:
- **Sent by email** to the address provided by the customer (digital PDF voucher with QR code), or
- **Made available for physical pickup** at one of our three offices in Rome
Trips to Rome vouchers or single components of the package are associated with a unique code. This code is verified by the Service Provider at the time of service access.
### Rights of the voucher holder
If the Trips to Rome voucher has not yet been used, is still valid in time, and contains all necessary details, the voucher (or its single components) **grants the holder the right to conclude the contract with the Service Provider without further payment for the service itself**.
The customer will then be granted access to the booked service. After scanning the individual code or delivery of the corresponding voucher, the voucher (or its components) is invalidated so it no longer entitles new use of the service.
### Non-transferability
Vouchers issued by Trips to Rome are **personal and non-transferable to third parties** unless explicitly authorized by Trips to Rome. It is not permitted to duplicate, modify or alter the voucher in any way.
If Trips to Rome has grounds to suspect unauthorized duplication, it has the right to transmit stored information to the Service Provider and initiate legal action.
### Single use
Unless otherwise specified on the product page, a Trips to Rome voucher grants the right to use the booked service **once only**. If the voucher value is not fully used or the service is not fully consumed, **the unused difference is forfeited**. No partial refunds are provided for partially used services.
### Validity period
All Trips to Rome vouchers are issued with a **specific validity date**. After this date, the voucher is no longer usable. Provider services can only be used within the validity period indicated on the voucher.
If the voucher covers "by day" periods of use (e.g. 24h/48h/72h transport tickets, 24h/48h Open Bus), the validity period **starts from the first use on the first day** and continues for subsequent consecutive days as specified.

## IV. Prices and payment
Prices shown on the site are expressed in **Euros (€)** and are inclusive of VAT, unless otherwise indicated.
### Accepted payment methods
- Credit cards (Visa, Mastercard, American Express)
- PayPal
- Any other methods specified at checkout
### "Pay on Pickup" mode
For specific products marked as **"Pay on Pickup"** (e.g. Open Bus Hop-on Hop-off), a mixed payment mode is available:
- The customer pays a **€5 deposit** at the time of online order
- Settles the remaining amount at pickup at one of our offices
This mode is explicitly indicated on the product pages that offer it. In case of no-show, the €5 deposit is non-refundable.
### Discount codes
Any discount codes distributed (e.g. "WEDNESDAY" promo) are applicable at checkout according to the conditions indicated on the individual code. No more than one discount code can be combined per order, unless explicitly stated otherwise.

## V. Warranty and liability
### Services included in packages
Combo products or passes (e.g. Rome Move Pass 48H, combined packages) include the services, admissions and prices in force at the Service Provider (museum, attraction, carrier, etc.) **at the time of purchase**.
### Trips to Rome warranty
Trips to Rome warrants that the voucher grants the holder the right to use the Service Provider's service.
If the Service Provider denies the customer the service booked through Trips to Rome (for causes not attributable to the customer), any claims against Trips to Rome shall be limited to **proportional refund of the purchase price**. The customer's rights arising from culpable breach by Trips to Rome remain unaffected.
### Refund exclusions
**No refund** (of the purchase price or part thereof) is due in the following cases:
- Museums, attractions, tours or other contents closed during the pass usage period for reasons unknown to Trips to Rome at the time of purchase
- **Force majeure**: strikes, demonstrations, fires, riots, road blockades, extreme weather conditions, pandemics, government acts
- Exceptions to standard admission rates, such as temporary free or reduced admissions on special days (e.g. "Free Museum Sundays", "Culture Week"), falling within the individual usage period
- Changes to individual contents occurring between product launch, purchase and subsequent individual use (e.g. attraction closure, venue change, end of cooperation with a provider, introduction of booking obligations, new pass contents)
Current updated contents are communicated on tripstorome.com.
### Issue management procedures
If one or more services cannot be delivered for circumstances not attributable to Trips to Rome, **we will promptly inform the customer** (including by publication on the website) as soon as we are aware.
In case of issues redeeming the voucher, Trips to Rome will work to find a solution. The customer can contact our support service:

### Limitation of liability
Trips to Rome **does not warrant the service purchased from the Service Provider**. The service is delivered by the Provider in their own name and for their own account; therefore Trips to Rome is not liable to the customer for the Provider's breaches during service delivery, except in cases provided by mandatory consumer protection legislation.
Except in cases of wilful misconduct or gross negligence, and within the limits permitted by applicable law, Trip to Italy srl's overall liability to the customer shall not exceed the amount actually paid by the customer for the disputed service.

## VI. Tourist packages (combos)
Products that combine two or more tourist services (e.g. **Rome Move Pass 48H** including public transport + Open Bus + Colosseum + Boat + Transfer + SIM) may fall within the definition of **"tourist package"** pursuant to:
- **EU Directive 2015/2302** on package travel and linked travel arrangements
- **Italian Tourism Code** (Legislative Decree 79/2011 as amended by Legislative Decree 62/2018)
In this case, the protections provided by the regulation apply, including:
- Pre-contractual information obligation
- Right to transfer the package to third parties
- Reimbursement and repatriation guarantee in case of organizer insolvency
- Traveller assistance in case of difficulty
- Price reductions for non-conformity

## VII. Cancellation, modification and refunds
We believe in transparency. We tell you upfront what's important to know, without hidden fine print.
### 7.1 Standard cancellation terms
For **most products**, cancellation is free up to **24 hours before** the date of use or pickup. Within this window:
- Full refund of the amount paid (except the non-refundable Pay on Pickup deposit)
- No penalty
This rule applies to:
- Public transport tickets (CIS, 24h/48h/72h tickets, Roma Pass)
- Tickets for attractions and museums (Colosseum Fast-Track, Vatican, etc.)
- Tiber River Boat
- Open Bus Hop-on Hop-off
- Single airport transfers
- Other products except for exceptions stated on the specific product page
### 7.2 Exceptions: products with 7-day cancellation
Some products, due to the nature of the service offered (advance allocation of skip-the-line slots, booking of guides and private vans), have stricter terms:
- **Rome Move Pass 48H**: free cancellation up to **7 days before** the first day of use
- **Roma Cristiana VIP**: free cancellation up to **7 days before** the tour date
- Other products may have specific terms always stated on the product page
In case of cancellation outside the free terms, the amount is not refunded. Trips to Rome may, at its discretion and within operational limits, evaluate alternative solutions (date change, equivalent voucher).
### 7.3 Refund methods
Refunds are credited to the **original payment method** (credit card or PayPal) within **5-10 business days** of cancellation confirmation, subject to the customer's bank technical times.
For orders where no physical voucher has been delivered yet, the refund is processed within **14 days** of cancellation confirmation.
### 7.4 Return of physical vouchers
If the customer has received **paper vouchers, physical passes** or other entry permits, they are required to return all components to Trip to Italy srl within **15 days** of the first day of validity. Returned items must be:
- Unused
- Undamaged
- Without annotations or markings
The refund (net of any documented costs) will be processed once returned items have been received and inspected.
### 7.5 Booking modifications
For modifications (date change, change in number of people, etc.) the customer can contact us via WhatsApp, email or at one of our three offices.
- **Within the free cancellation window** (24 hours or 7 days depending on the product): free modification
- **Outside the window**: we evaluate case by case. In many cases we can accommodate, especially for dates within the next 30 days
Date modifications are subject to availability of the new date. If the alternative date has a higher price, top-up of the difference may be required.
### 7.6 No-show
In case of failure to use the service without prior notice (no-show), **no refund is due**. This is because most products include allocations prepared specifically for the customer (Colosseum slots, places on guided tours, pre-issued vouchers).
### 7.7 Right of withdrawal (tourist services)
Pursuant to **Article 59 of the Italian Consumer Code (Legislative Decree 206/2005)**, **tourist services of fixed duration and tickets for services provided on specific dates are excluded from the ordinary 14-day right of withdrawal** provided for distance contracts. The cancellation terms of the individual product apply, as indicated above.

## VIII. Website functionality
Trips to Rome reserves the right to modify, limit or interrupt the scope and functions of the website at any time, **if not necessary for the performance of contracts already concluded**.
Although Trips to Rome strives to provide the service without technical interruptions, maintenance, further developments and other interruptions may limit or temporarily suspend its use. In some circumstances this may cause data loss.
Therefore Trip to Italy srl **does not guarantee uninterrupted service availability** nor the absence of technical disruptions or data loss.

## IX. Reviews, comments and user content
By submitting content and information on the site (including reviews, tips, photographs):
### 9.1 Rights ownership
The user **warrants ownership** of the submitted content and therefore holds copyright on such content.
If the user is not the rights holder, they warrant having obtained all necessary authorizations, licenses, permissions for content submission. Otherwise, the user releases Trip to Italy srl from any liability to third parties.
### 9.2 License to Trip to Italy srl
By submitting content, the user grants Trip to Italy srl and its affiliates the **non-exclusive, royalty-free, perpetual, transferable, irrevocable and sub-licensable right** to use the submitted content in any form (online, print, telecommunications). These rights include:
- Reproduction
- Distribution
- Public reproduction
- Making available photographs and audio recordings
The original context of submitted reviews, tips and photographs is respected. The rights mentioned above are **revocable** if submitted photographs include identifiable persons.
### 9.3 Content customization
The user accepts that images and texts may be moved to other site sections for layout reasons, and that images may be downsized. Trip to Italy srl may also edit or delete content to preserve moral rights and translate content into different languages.
### 9.4 Advertising placements
Trip to Italy srl reserves the right to add advertisements in the vicinity of publicly accessible content and/or carry out other promotional measures. The user explicitly accepts these conditions.

## X. Resale and commercial use
**Commercial resale** of Trips to Rome vouchers or their use for non-strictly-private purposes (e.g. commercial raffles, auctions, competitions) **is not permitted** unless prior consent of Trip to Italy srl is obtained. Such consent will not be unreasonably withheld.
In case of breach of this condition, Trip to Italy srl reserves the right to claim damages and invalidate the vouchers in question.

## XI. Copyright
Trip to Italy srl reserves copyright and other rights on published content, information, images, videos and databases of the tripstorome.com site.
It is expressly **forbidden to modify, duplicate, publish, transmit to third parties or otherwise exploit** the content mentioned above without prior written consent of Trip to Italy srl. The same applies to content belonging to Service Providers.

## XII. Customer obligations
The customer is required to:
- Provide correct and complete data at the time of purchase
- Verify travel documents (passport, visas) necessary to access services
- Respect access rules at museum sites, transportation, third-party services
- Show up promptly at pickup or service activation
- Respect Trips to Rome operators and third-party Providers
In case of failure to comply with these obligations, Trip to Italy srl reserves the right to refuse service delivery **without right to refund**.

## XV. Changes to the Terms
Trip to Italy srl reserves the right to modify these Terms at any time. Changes will be effective from the date of publication on the site.
**For orders already finalized, the Terms in force at the time of purchase remain applicable**.

## XVI. Severability clause
If one or more clauses of these Terms should prove invalid or ineffective, this shall not affect the validity of the remaining clauses. Invalid clauses shall be replaced by the corresponding applicable Italian law provisions.

## XVII. Applicable law and jurisdiction
These Terms and Conditions are governed by **Italian law**, excluding the provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For any dispute arising from the interpretation or execution of the contract, the **Court of Rome** has exclusive jurisdiction, without prejudice to the mandatory protections provided in favor of the consumer (forum of consumer's residence or domicile).
